Terms of Use
The terms that apply when you use the Spark app.
1. Agreeing to these terms
By creating an account or using Spark, you agree to these Terms of Use and to our Community Guidelines, which form part of this agreement. If you do not agree, do not use Spark.
If you downloaded Spark from the App Store, Apple's Standard End User License Agreement may also apply. These terms do not replace it: Apple's agreement covers the software licence, and these terms cover how Spark is used and what is expected of you here. Where the two overlap, both apply.
Spark is operated from the Netherlands.
2. Who may use Spark
You must be 18 or over. Spark is for gay, bi, trans and queer men and for the people who date them.
You may hold one account. You may not use Spark if a previous account of yours was permanently removed, and you may not create a new account to get around a suspension.
3. Conduct that is not allowed
There is no tolerance for objectionable content or abusive behaviour on Spark.
You agree not to post, send or share content that:
- involves anyone under 18, in any form;
- harasses, threatens, intimidates or incites violence against anyone;
- is racist, transphobic, biphobic, or attacks people for their body, HIV status, or who they are;
- outs someone, shares their contact details, or reveals private information about a person without their consent;
- shares intimate images of another person without their consent, or threatens to;
- impersonates another person, or presents photos that are not of you;
- advertises sex work, drugs, or any other goods and services;
- encourages self-harm or suicide;
- promotes conversion therapy or hate groups.
Sexually explicit images may not appear on your public profile. Between consenting adults, in private, they are permitted.
The Community Guidelines set out these rules in full, with examples. They apply as written there.
4. Consent, and how private media works
Ask before you send something private. Consent to see something once is not consent for next week, and someone who agreed can change their mind. Nothing in the app replaces that conversation.
What the app does is make the moment of choice real. Nothing private arrives uncovered: a photo you send in a chat, or an album you share, reaches the other person hidden — the image is not even downloaded until they choose to open it. That choice is theirs, every time, and you cannot make it for them.
Access can be taken back. Whoever shared an album or a photo can end access at any moment, at no cost, and it takes effect immediately.
5. What happens if you break these rules
We may remove content, issue a warning, suspend your account, or remove it permanently. Which of those we do depends on what happened and on whether it has happened before.
Content involving minors, credible threats of violence, and non-consensual intimate images lead to immediate permanent removal, without a warning and without an appeal period. Where the law requires it, we report to the authorities.
For a permanent removal on other grounds, you have 14 days to appeal by writing to support@hi-spark.app.
6. Reporting
Every profile and every conversation has a report option. Reports are not shown to the person you report. We review what is reported together with its context, and we will confirm that your report arrived — we do not disclose what we decided about someone else's account.
7. Your content
What you post stays yours. You give us permission to store it and to show it to other members, for as long as it is on Spark — no longer, and for nothing else.
Delete your account and your profile, photos, and messages go with it.
8. Meeting people
Spark introduces people. What happens after that is between you and them: we do not verify that members are who they say they are, and we are not responsible for what anyone does off the app.
Meet in public the first time, tell someone where you are going, and use Safety Check-In if it helps.
9. Location
Spark shows other members roughly how far away you are. We round every distance before it leaves our servers and never share your coordinates, but an approximate distance is still information about where you are — and someone who checks it from several places could narrow that down.
You can turn off Show my distance in Privacy settings at any time. If where you are is sensitive, do that before you browse.
10. Ending this agreement
You can delete your account at any time in Settings. We may end your access if you break these terms, as set out in clause 5.
11. Changes
If we change these terms in a way that matters, we will tell you in the app before the change takes effect.
12. If someone else claims against us because of you
If a third party brings a claim against us that arises from what you posted, what you did on Spark, or from your breaking these terms, you cover our reasonable costs in dealing with it.
13. What we are and are not responsible for
Spark is provided as it is. We do our best to keep it running and safe, but we cannot promise it will always be available or free of faults.
Our liability is limited as far as the law allows. Nothing here limits our liability for death or personal injury caused by our negligence, for intent or gross negligence on our part, or for anything else the law does not permit us to exclude. If you live in the EU, your statutory consumer rights apply in full.
14. Law
These terms are governed by the laws of the Netherlands. If you live elsewhere in the EU, you keep the consumer protections of your own country.
